About Lawyer
Stephen Fay is the Senior Practice Counsel for the Hamilton/Oakville Offices of Aviva Trial Lawyers. He joined A.T.L. in May of 2016. Prior to joining A.T.L. Stephen was the leader and practice manager of the insurance defence team at Swaye & Associates in Hamilton. At Swaye & Associates Stephen’s practice was restricted to acting on behalf of Insurers; he defended claims in the areas of motor vehicle accidents, occupiers’ liability, social host liability, products liability, professional negligence and fire losses. Stephen has conducted in excess of 30 jury and non-jury trials in Southern Ontario and argued numerous times in the Ontario Court of Appeal. He has been involved in many precedent setting cases including being lead counsel in Nichols v. American Home Assurance Co. which clarified the law in Canada regarding an Insurer’s duty to defend. Stephen has extensive mediation experience and was a panel participant with Ole Larsen on the topic Successful Mediation Tactics at the Hamilton Law Association 2014 Advocacy Conference.
Personal Interests
Stephen lives with his wife and 13-year-old daughter in Burlington. He enjoys travelling, golf and the occasional workout at the YMCA. He spends many weekends watching his daughter participate in show jumping.
